How long does it take for a prosecutor to clear a load of shot in a case of self defense?
This is a story I'm writing, I am looking to find out how long the DA clear that a charge of shooting in a case of self-defense by a person who is licensed to carry concealed. In the book of the 1st my hero shoots 2 men in self defense and shot his unarmed employer in the leg to prevent the escape because he was shot too. Note that the story is Buffalo, NY. (A very tough state gun law that I know) If you need more information please contact me and ask. Also there is no time difference eight months between 1 and 2 books. So I need to know if the charges may be pending or have been resolved by the time the new story takes place.
If someone shot him in self defense – that is, shot the person because the person who was trying to harm or kill him – then the charges likely never brought against him in the first place (assuming the stage was clear). If the charges against him were improperly, then the amount of time needed to clarify charges depend on how long it took to clarify the situation in self defense. However, can not shoot someone in the leg to prevent him from escaping. That not self-defense – which is an assault with a deadly weapon (aggravated battery is probably the technical and legal term, but I'm not sure why).
